Banner Witcoff secured a significant early win for its client Commerce Bank after the U.S. District Court for the Western District of Missouri denied a motion for preliminary injunction filed by Revenue Management Solutions, LLC (RMS).
RMS sought to bar Commerce Bank from continuing to use its healthcare payment-processing platform and from allegedly disclosing confidential information or trade secrets. The court found that RMS failed to demonstrate a “threat of irreparable harm,” which the judge described as “a sufficient ground upon which to deny a preliminary injunction.”
The decision emphasized that RMS’s claimed injuries—such as loss of customers, goodwill, or price erosion—were “speculative” and agreed that halting Commerce’s platform would have caused significant disruption to customers and their patients and raised potential regulatory compliance issues.
The court’s decision allows Commerce Bank to maintain use of its platform and continue normal operations as the case proceeds.
