Banner & Witcoff Announces that it Prevailed in a Patent Infringement Suit on behalf of CIBA Vision Corp.

Banner & Witcoff, Ltd. announced today that it prevailed on behalf of CIBA Vision Corp. in a patent infringement lawsuit that was pending in the U.S. District Court for the District of Delaware.

On November 21, 2007, Judge Sue L. Robinson entered a consent judgment in CooperVision, Inc. v. CIBA Vision Corp. The Court ruled that CIBA’s U.S. Pat. Nos. 5,760,100; 5,789,461; 5,489,811; 5,766,999; 5,965,631; and 6,951,894 were “valid and enforceable in all respects.” The Court further held that CIBA’s development of silicone hydrogel contact lenses represented a breakthrough in contact lens technology, as exemplified by these patents. This patented technology allows up to 30 days and nights of continuous wear of CIBA’s O 2OPTIX™ and Night & Day® contact lenses.
