Banner Witcoff attorneys Robert Katz and Sean Jungels have authored an article published by IAM Media titled “The Federal Circuit Is Moving Design Patent Law in the Wrong Direction.”
The authors write, “The U.S. Court of Appeals for the Federal Circuit got it wrong in Range of Motion Products v. Armaid Company Inc., distorting principles in ways that further destabilize design patent law.”
The article contains a detailed analysis of the decision and what it got wrong. It also analyzes the dissent which provides promising thoughts to correct the wrongs set forth in the decision.
