Mr. Rivard discusses potential outcomes of the Federal Circuit’s en banc rehearing in Lighting Ballast Control v. Philips Electronics North America in a Law360 article titled, “Fed. Circ. Claim Construction Case May Boost Patent Deals.”
The oral argument is set for Sept. 13, 2013, and will focus on whether to overturn the 1998 ruling in Cybor Corp. v. FAS Techs. Inc., which held that district court claim construction rulings should always be reviewed de novo.
