Mercedes speaks to the Federal Circuit’s decision to uphold the USPTO’s decision to invalidate four Cellect patents for obviousness-type double patenting, stating, “I think a lot just depends on the court and what their philosophy is. But legislative intent on a lot of things seems to be getting forgotten.”
