Banner & Witcoff is pleased to report that a summary judgment in favor of AOL was granted in the Chicago patent case of Windy City Innovations, LLC v. America Online, Inc. (No. 04C4240 N.D. Ill. 2004).

Banner & Witcoff and Latham & Watkins attorneys represented AOL in federal court in Chicago against allegations of patent infringement directed at AOL’s Instant Messaging and Chat services. The Court granted AOL’s motion for summary judgment on the reasoning that the accused services do not infringe in the patent suit.

The Banner & Witcoff team of attorneys included Charles Shifley, Janice Mitrius, Allen Hoover, Phoebe Phillips Bower, and Justin Busch.
