Abitron Austria GmbH v. Hetronic International, Inc.: Rich Stockton Presents at Chicago-Kent College of Law’s 2023 Supreme Court IP Review 

Rich Stockton will participate as a panelist at Chicago-Kent College of Law’s 2023 Supreme Court IP Review on Friday, September 29.

Alongside his co-presenters, Rich will review the Supreme Court decision in Abitron Austria GmbH v. Hetronic International, Inc. In Abitron, the Supreme Court ruled that the Lanham Act did not rebut a judicial presumption against extraterritoriality, and therefore that the Lanham Act may only have “domestic application.” However, the Justices split 5-4 regarding what constitutes a “domestic application.” Rich previously authored an Amicus Curiae brief with the American Intellectual Property Law Association about the decision.

The Supreme Court IP Review is designed to provide intellectual property practitioners, jurists, legal academics, and law students with a review of IP cases from the U.S. Supreme Court’s previous Term, a preview of cases on the docket for the upcoming Term, and a discussion of cert. petitions to watch.
