On April 20, 2011, the Court of Appeals for the Federal Circuit issued an en banc decision in TiVo Inc. v. EchoStar Corp. The Federal Circuit decision vacated the district court’s holding of contempt of the infringement provision and remanded for the district court to make a finding concerning any colorable difference between the previously adjudicated infringing devices and the newly accused devices. The Federal Circuit decision vacated in part the damages awarded for continued infringement and affirmed the district court’s finding of contempt of the disablement provision of the district court’s injunction and the sanctions imposed by the district court.
