Banner Witcoff attorneys Christopher McKee and Camille Sauer wrote a March 4 article for Westlaw Today about a development involving one of the patent review procedures brought forth by the America Invents Act.
In their article, Chris and Camille examine the rising number of Patent Trial and Review Board (PTAB) discretionary denials and Post-Grant Review (PGR) filings.
“As PGR comes to be viewed as a more viable and attractive option, and with the number of PGR filings on the rise, it is increasingly important to understand how the PTAB approaches § 325(d) denials in the case of PGR,” they wrote.
Their article — “Rising PTAB discretionary denials and popularity of PGR bring into focus a special case: § 325(d) discretionary denials in PGR” — is available online and was also published in the March 10 edition of Westlaw Journal Intellectual Property.
