Wayne’s practice focuses on patent prosecution and counseling, including the evaluation of patent infringement and validity issues. He also offers significant experience with preparing and prosecuting patent applications in various software, electronic and mechanical fields.

In addition to his prosecution and counseling practice, Wayne has experience in other areas of intellectual property law, including inter partes review (IPR) proceedings before the U.S. Patent and Trademark Office and litigation.

With nearly three decades of legal experience and a background in mechanical engineering, Wayne has extensive knowledge in a wide range of technologies, including networking, wireless communication, video processing, computer input devices and other computer hardware, medical devices, footwear and apparel, manufacturing, and rescue/tactical equipment, among others.

Wayne — the editor-in-chief and a chapter author of Drafting Patents for Licensing and Litigation, Third Edition — serves as an advisor and a reviewer at Banner Witcoff, where he helps teach new attorneys and technical specialists how to prepare patent applications and perform prosecution-related activities. He is a former co-chair of Banner Witcoff’s PTAB Committee, which tracks the firm's vast experience and knowledge in post-issuance review proceedings. Before launching his patent law practice and joining Banner Witcoff, Wayne was a general commercial litigator with a large law firm in Tampa, Florida, where his experience representing clients in a wide variety of contexts provided valuable business insights. Prior to earning his law degree, he worked as a mechanical engineer for a United States government laboratory, where his duties focused on mechanical design and testing in the field of underwater vehicles. While in law school, he served on the board of the Florida Law Review and graduated as a member of the Order of the Coif.
