Coriant Operations, Inc. and other co-petitioners v. Capella Photonics, Inc.

Coriant Operations, Inc. and other co-petitioners v. Capella Photonics, Inc. Nos. IPR2015-00816, IPR2015-00894, IPR2015-01969, IPR2015-01958, IPR2015-01961 and IPR2015-01971, at the USPTO Patent Trial and Appeal Board.

In six inter partes reviews, Banner & Witcoff client Coriant Operations prevailed, along with co-petitioners, when the PTAB issued final written decisions that all claims at issue in two asserted patents were unpatentable. The Federal Circuit affirmed the PTAB decisions. The patents relate to fiber-optic multiplexors. Banner & Witcoff represented Coriant in all six of these IPRs and the Federal Circuit appeals.

Banner & Witcoff also represents Coriant in litigation alleging infringement of these patents pending in the U.S. District Court for the Northern District of California. Coriant and the other co-defendants successfully obtained a stay of the litigation pending the outcome of the IPRs.
