Mr. Wright discusses the CAFC’s decision to rehear Tafas v. Doll, in IP Law360 and BNA’s Patent, Trademark and Copyright Journal. Mr. Wright notes that it is likely the judges will change some aspect of the decision, as it is unlikely they would take case en banc only to endorse the majority view.
