Mr. McDermott’s practice focuses on corporate management’s coordinated procurement, licensing and litigation of intellectual property rights, in support of competitive market position. His broad licensing experience includes preparing and successfully negotiating patent licenses and other technology transfer agreements covering technologies such as medical devices, polymer coatings, glass fabrication, automotive components, fiber optics and plastic moldings. He has handled licensing and due diligence studies in support of acquisitions, divestitures and corporate joint ventures of U.S., European and Asian corporations. He has also served as an expert witness on licensing and patent issues.
Prior to Banner & Witcoff, Mr. McDermott served as in-house counsel at Ford Motor Company. This exceptional opportunity provided deep experience in crafting coordinated intellectual property strategies to support forward product planning for multiple business units of the company, including the Glass Division and the Plastic Products Division. An insider’s familiarity with corporate operations has provided insights that continue to inform his practice.
Mr. McDermott has also worked closely with entrepreneurs and startups, again focusing on the development and exploitation of coordinated intellectual property portfolios. He has served as an executive board member and chairman of the Venture Forum, a non-profit program supporting pre-start-up and early-stage, technology-based businesses. He has also served as a core member of the faculty for the Ewing Marion Kauffman Foundation’s Global Scholars Program. Through this program, Mr. McDermott taught the broad principles of intellectual property law to young entrepreneurs selected from European and Asian engineering, science and technology scholars. Currently, he is one of the featured experts in the Kauffman Founders School, an online video education program for business founders, established and curated by the Kauffman Foundation.
Mr. McDermott has authored and co-authored articles related to patent law and licensing, and co-chaired law seminars and been a speaker on patent law and licensing on numerous occasions. He has also lectured on patent law at engineering schools, including Worcester Polytechnic Institute and Tufts University. He serves in appointed positions on the Lawyer Referral Service Committee and the Media Committee of the Massachusetts Bar Association. He is also a member of the Intellectual Property Owners Association, where he serves as a member of the IP Licensing Committee.
Mr. McDermott was named by Intellectual Asset Management magazine as one of the “World’s Leading Patent & Technology Licensing Lawyers,” and was selected for inclusion in the 2014 edition of The Best Lawyers in America. Best Lawyers is considered the oldest and most respected national peer-review publication in the legal profession, and is based on an annual peer-review survey. Mr. McDermott has for years been selected by his peers as a “Super Lawyer” in the field of intellectual property law.
Mr. McDermott has been admitted as a member of several state and federal district and appellate court bars, including Massachusetts and Michigan. He earned his J.D., with honors, from Suffolk University Law School in 1978. He earned his B.S. in chemical engineering at Worcester Polytechnic Institute, where he has served on various alumni committees.
